Default What is the Law regarding Personal Protection within your own home?

Should an intruder or burgler enter my house, In order to protect my family i would want to disable him as quickly as possible, The best means in my opinion of doing this is with the least amount of voilence is mace spray.

Where does the law stand on mace spray? is it legal to possess in your own home? Can you use it in self defense? also what strength is legal/illegal (there are versions more powerful than others)

On a politcal rant note. If we had a 2nd amendment like the United States there would hardly be any burglaries in this country. No one breaks into a house in Texas because they know they are going to get shot the minute they try it. You do that in England and you are facing life imprisonment,But thats fine because all the villians all have guns and we have the worst burglary rate in Europe.

It is an illegal weapon, illegal to own

You may only use reasonable force.

In the United Kingdom, "Any weapon of whatever description designed or adapted for the discharge of any noxious liquid, gas or other thing" is classed as a section 5 firearm (Firearms Act 1968 http://www.cps.gov.uk/legal/section12/chapter_b.html). The same act covers other prohibited weapons such as automatic firearms and rocket launchers, all of which can only be possessed by permission of the Home Secretary. Although legal for police officers, recent debates have arisen whether such a weapon should be legal for civilians as means of defensive purposes only. At present a number of legal alternative dye sprays are sold in the UK which have the effect of temporarily blinding the attacker but do not constitute noxious substances and so do not contravene this act. The good news (for you) - Looks as if a number of EU countries allow its use and as you know many laws are up for review to ensure everyone's on the same page, if you will. Still, Brits will protect their hooligans.

you have the right to protect yourself.

that's the bottom line.

for example....

if you believe that the person you are confronting is capable and would (if given the chance) "throw the first punch" and would if given the chance harm or damage you, you (by law) are entitled to throw it first! to disable him/her (make sure it's a good one)

after saying that always use reasonable force!!

NO MACE...It is regarded by the law as a Firearm...(complicated mumbo jumbo in "Archbold")

You could go for something legally blinding like hair spray, deoderant or WD40..

I the US and particularly California, if you break in and you feel that you or your family is threatened you can use whatever means necessary to reduce or eliminate that threat. At my place, you break in you're dead before you hit the ground........44 mag!

According to our law, we should just let them take what they want and call the police after and wait for them to deal with it (I know, you can stop laughing, apparently police do sometimes check out burglaries!). Honestly, but if they are threatening you and your family you are allowed to use reasonably force, as in tackle them to the ground, but don't hurt them or they can sue you...
In other words - just don't get burgled!
I live on a farm so I have guns in the house, if ever anyone breaks in they will firstly get mauled by the dogs, if they survive that I'm shooting to kill. At least if they are dead they can't sue!

Well ,just what is the law in my home? If I don't know ya , you're out !! If you made it into the house,,That's gonna be bad for you.. I will back into a corner and claim invasion of space ,,Shame on you!!! If me ,, or my family ,are under the threat of harm,,shame on you ... I'm sorry but that's the way it is in my house ... Very disciplined,, but ,, death before dishonor... Otherwise, what's mine is yours'...
