It can't hurt to talk to your neighbor, maybe they would love to see new paint on the fence again. If not. Do like the others advised, paint your side and forget about it.

what is a trespass...you stand in your neighbors yard; he asks you to leave but you don't leave immediately. that is a tress pass. ( some other rules apply for schools and Church's) ..paint the fence when he is not there...after all, your fence could rot if not painted...how is his grass harmed by spilling a little latex paint..it is going to be cut i 2 weeks. look it up and git r done!

Urm....why would you want to paint their side? you can't see it after all.

It is your fence, but that side is on their land. You need to ask permission to go onto their land to paint it or they can say that you trespassed.

Yes to both questions unless you can paint the side of the fence which is towards your neighbors without stepping on their land. I presume you were able to put up the fence on your own land and not encroaching on the portion belonging to them so you can paint the fence on both sides as long as you don't tresspass on their land. If you can't do it without trespassing on their land, you have to ask permission. They can charge you with trespassing not for painting the fence but for standing on their land in order to do it.

Ask them so that they don't call you for trespassing. Perhaps the gesture of painting their side of the fence may clear some of the animosity which presently exists.

Simply ask them, I'd expect they would appreciate you tidying up the side of the fence they have to look at. Then thank them for letting you in. If you're nice about it and they're nice about it you'll probably get on better in future. Other than that, you have no right to be there apart from for emergency repairs.
