Default "Faulty" Game?

Well, i bought Final Fantasy XII for the PS2 from tesco last friday and i stupidly put the disc in my pocket when i went over my friends with it. As you can image the disc snapped. It isn't snapped into any pieces it just has a large line through the disc. Now i know this is probably illegal or something, but if i returned it with the reciept and said that when i opened the packaging the disc was already broked would i be entitled to a refund/exchange?

i doubt it cos the person actually puts the CD into its case when you buy the game dont they? so theyd know if it was snapped.

Possibly, how would they ever know, it was an accident, right? As long as you bought a game, cd, electronic, etc. you should be able to return an item within so many days of owning it. Maybe they can replace the game.
